Term Of Use

Term Of Use

  • Terms and Conditions

    By placing an order for any of our products, you are agreeing to be bound by the following terms and conditions (Terms and Conditions). We recommend you print a copy of these Terms and Conditions for your future reference.

    General

    1.1 Auto Nexus Hub reserves the right to change these Terms and Conditions at any time. Any changes will take effect when posted on our website.

    1.2 If you are purchasing on behalf of a business, you confirm that you have the authority to bind the business to these Terms and Conditions.

    Order Process

    2.1 When choosing which products to purchase, please use the measurements and diagrams provided in our product listings.

    2.2 All orders placed are subject to acceptance in accordance with these Terms and Conditions. These Terms and Conditions apply to the exclusion of any other terms that you seek to impose or incorporate, or that are implied by trade, custom, practice, or course of dealing.

    2.3 An order placed constitutes an offer by you to purchase products in accordance with these Terms and Conditions.

    2.4 An order is only deemed to be accepted when we have taken payment from your card, at which point a contract (Contract) shall come into existence.

    Delivery, Risk, and Title

    3.1 We will aim to fulfill your order within 30 days, or within such timescale as agreed by both parties.

    3.2 The products will be at your risk from the time of delivery.

    3.3 Ownership of the products will only pass to you once we have received full payment for all sums due, including delivery charges.

    Price and Payment

    4.1 The price of the products will be as quoted on the website at the time of ordering, except in cases of error. In the event of an error, we will inform you and give you the option to reconfirm the order at the correct price or cancel it. If we cannot contact you, we will treat the order as canceled. If you cancel and have already paid, we will issue a full refund.

    4.2 All prices include VAT (where applicable) at the current rates but exclude delivery charges unless stated otherwise.

    4.3 Payment for all products must be made via PayPal, credit card over the phone, or BACS. We will take payment once we have confirmed your payment details and stock availability. Products are supplied subject to availability. If we are unable to supply a product, we will inform you as soon as possible, and a full refund will be provided if payment has already been made.

    Consumer Rights

    5.1 If you are contracting as a consumer, you have the right to cancel the contract within seven working days from the day after you received the products. You will receive a full refund of the price paid for the products in accordance with our refund policy.

    5.2 To cancel the contract, you must inform us in writing. If rejecting products, you must return them to us at the address provided, in the same condition in which you received them, at your own cost and risk. You have a legal obligation to take reasonable care of the products while in your possession. If this obligation is not met, we may seek compensation for any damages.

    Returns, Cancellations, and Substitutions

    6.1 When returning a product:

    a) If you cancel the contract within the seven-day cooling-off period, we will process the refund as soon as possible, but no later than 30 days from the cancellation. A full refund will include the cost of delivery, but you are responsible for returning the products to us.

    b) If the product is defective or for any other reason, we will examine the returned product and inform you of your refund status within a reasonable time. In case of defect, we will refund the full amount, including the original delivery charge, and the cost incurred by you for returning the product.

    6.2 We will refund money using the same method originally used for payment.

    6.3 If product specifications from the manufacturer change, we will try to offer a suitable substitute of the same or higher quality at the same price.

    Warranty

    7.1 We warrant that products purchased from us are of satisfactory quality and fit for the purposes they are commonly supplied for.

    7.2 This warranty does not apply if the products:

    a) are modified after purchase;
    b) are mishandled or negligently cared for (e.g., cleaned with harsh chemicals);
    c) are damaged from road hazards or heavy impacts;
    d) are used in a vehicle with a weight exceeding the specified limit;
    e) are used in competitive or off-road conditions;
    f) are fitted to a modified vehicle that contributed to the warranty breach;
    g) are installed improperly or without the required expertise;
    h) have incorrect specifications for the vehicle.

    Liability and Indemnity

    8.1 Our liability is strictly limited to the purchase price of the product and any foreseeable losses. Losses are foreseeable if they could be anticipated by both parties when the order was placed. Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by negligence.

    8.2 We are not responsible for indirect losses such as:

    a) loss of income or revenue;
    b) loss of business;
    c) loss of profits or contracts;
    d) any loss that was not foreseeable by both parties at the time of ordering.

    8.3 We will take reasonable precautions to keep your order and payment details secure but cannot be held liable for any unauthorized access unless due to our negligence.

    Events Outside Our Control

    9.1 We are not responsible for failure to perform, or delays in performance, due to events outside our reasonable control (Force Majeure Event).

    9.2 Force Majeure Events include:

    a) strikes, lock-outs, or other industrial action;
    b) natural disasters such as floods, storms, or fires;
    c) disruptions to transport or telecommunications;
    d) government actions or restrictions.

    9.3 Our performance is suspended during a Force Majeure Event, and we will make reasonable efforts to resolve or mitigate the situation.

    Miscellaneous Provisions

    10.1 These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.

    10.2 You may not assign or subcontract your rights or obligations under these Terms and Conditions unless agreed upon in writing by us.

    10.3 We may transfer or assign our rights and obligations to third parties.

    10.4 If any clause is deemed invalid, the remaining clauses will continue to apply.

    10.5 These Terms and Conditions constitute the entire agreement between us and supersede any prior arrangements or agreements.

    10.6 Failure to enforce any part of these Terms and Conditions will not constitute a waiver of our rights.

    10.7 Notices to you will be sent to the address provided by you or to your registered business address. Notices to us should be sent to Auto Nexus Hub.
